Why Now

The clock is ticking for battery manufacturers

The EU Battery Regulation 2023/1542 is the most significant compliance shift in the battery industry since REACH. Non-compliance means batteries cannot be placed on the EU market.

February 2027 deadline

All EV batteries, industrial batteries above 2kWh, and LMT batteries sold in the EU must carry a Digital Battery Passport. No exceptions, no extensions.

🌍

Global market impact

Any battery manufacturer exporting to the EU — including those based in the UK, US, China, and South Korea — must comply. This affects over 80% of global battery production.

💰

Investment opportunity

Early movers gain competitive advantage. Automotive OEMs and tier-1 suppliers are already requiring battery passport data from their supply chains ahead of the deadline.

📋

Complex requirements

The regulation requires 90+ data attributes including carbon footprint lifecycle assessment, supply chain due diligence for cobalt and lithium, and state of health tracking.

🔒

10-year data retention

Battery passport data must be retained for the lifetime of the battery plus 10 years. Immutable audit logs and tamper-proof records are mandatory.

🔗

Supply chain integration

Data must flow from raw material extraction through cell manufacturing, assembly, use phase, and end-of-life. Full chain-of-custody is required.

The Regulation

What EU Regulation 2023/1542 actually requires

Published in the Official Journal of the EU in July 2023, Regulation 2023/1542 replaces the 2006 Battery Directive and introduces mandatory Digital Battery Passports for the first time.

Carbon Footprint Declaration

Required from 2027
  • Full lifecycle CO₂ calculation (JRC methodology)
  • Carbon footprint performance class (A–G)
  • Third-party verification required above threshold
  • Carbon footprint study URL publicly accessible

Supply Chain Due Diligence

Required from 2027
  • Cobalt, lithium, nickel, graphite sourcing
  • Conflict minerals compliance (OECD guidelines)
  • Supplier audit trail and certification
  • Due diligence report publicly accessible

State of Health Tracking

Required from 2027
  • Real-time SoH monitoring and reporting
  • Cycle count and capacity fade tracking
  • Predictive end-of-life assessment
  • Data accessible to repair and second-life operators

Circularity & End of Life

Required from 2027
  • Recycled content percentages (Co, Li, Ni, Pb)
  • Dismantling and recycling instructions
  • Second-life potential assessment
  • Waste prevention measures documentation
⚠️

Non-compliance consequences

Batteries without a valid Digital Battery Passport cannot be placed on the EU market after February 2027. Market surveillance authorities can mandate product withdrawal. Penalties vary by member state but can reach up to 4% of annual EU turnover.
